Parenting Matters

Mediation and Court Representation
We are experienced advocates and can represent you in both mediation and Court proceedings.
Mediation is where an independent, neutral third party helps the parties to negotiate an agreement about the issues in conflict. In a parenting matter, mediation is a prerequisite before a matter can proceed to Court (except in some limited circumstances).
In a property matter, the Court generally Orders parties to attempt to settle their issues through mediation. There are various rules in place governing the family court process.
Court proceedings should always be considered as a last resort after every effort is made by the parties through their respective legal representatives, to negotiate a resolution of the matter by agreement, which can then be formalised.
Agency Work
We have solicitors available to act as agents in the FCFCOA, as well as the Latrobe Valley and surrounding Courts. We hold extensive advocacy experience in all types of family law matters including parenting, property, maintenance and child support. We have extensive experience appearing before the Judges at the FCFCOA. We are able to act as agent in relation to any type of family court event including mentions, interim hearings, conciliation conferences and mediations.
Independent Childrens Lawyer - ICL
ICLs represent children in family law matters and are involved in the most difficult family law cases by Order of the FCFCOA. When the court makes an order for an ICL it also requests that Legal Aid make an appointment of an ICL to the case. Our firm is appointed independently by Victoria Legal Aid.
Because your child won’t attend court, we as ICL will tell the court about your child’s welfare and views during the case. With the evidence that is before the court, we form an independent view of what is in the best interests of the child. The court will also be made aware of any views expressed by the child.

To ensure that we stay independent in the case, we are limited in what we are able to discuss with parents. If you are legally represented, any matters you wish to raise should be raised with your own lawyer who will contact us as the ICL.
Legal Aid Funding
Victoria Legal Aid assist people with their legal problems by offering legal representation for people who meet eligibility criteria, based on their financial situation, the nature and seriousness of their problem and their individual circumstances.
